Terms of Use

These Terms of Use (the "Agreement") constitute a legally binding agreement between Guardian Defenses LLC (hereinafter "GD," "we," "us," or "our") and you (the "User," "you," or "your") regarding your access to and use of the website located at [insert website URL] (the "Site") and any associated content, features, or services.

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not access or use the Site.

1. Acceptance and Changes to Terms

GD reserves the right, at its sole discretion, to modify or replace this Agreement at any time. Changes will be posted on the Site, and your continued use of the Site after any such changes constitutes your acceptance of the revised Agreement. It is your responsibility to review this Agreement periodically.

2. Eligibility

You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal capacity to enter into this Agreement. The Site is not intended for individuals under the age of 13, and access or use by anyone under 18 is prohibited without verifiable parental or guardian consent where required by law. By using the Site, you affirm that you meet these eligibility requirements.

3. License to Use the Site

Subject to your full compliance with this Agreement, GD grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and its content (the "Content") solely for your personal, non-commercial informational purposes.

The Content includes, but is not limited to, text, graphics, videos, training materials, documents, images, and other materials provided by GD or its licensors. All Content is owned by GD or its third-party licensors and protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any Content without GD's prior written consent. Unauthorized use may violate applicable laws and result in civil or criminal penalties.

4. Intellectual Property

All trademarks, service marks, logos, trade names, and other proprietary designations used on the Site are the property of GD or their respective owners. No license or right to use any such marks is granted without express written permission.

GD respects the intellectual property rights of others. If you believe your work has been infringed, please contact us at jharris@guardiandefenses.com with details of the alleged infringement.

5. Prohibited Conduct

You agree not to use the Site for any unlawful purpose or in any way that violates this Agreement. Prohibited activities include, but are not limited to:

  • Violating any applicable local, state, national, or international law;

  • Infringing intellectual property or other rights of GD or third parties;

  • Transmitting viruses, malware, or harmful code;

  • Attempting to gain unauthorized access to the Site or related systems;

  • Scraping, crawling, or using automated means to access or collect Content;

  • Interfering with or disrupting the Site's functionality;

  • Harassing, threatening, or defaming others;

  • Impersonating any person or entity;

  • Engaging in commercial activities without permission; or

  • Encouraging or facilitating any of the foregoing.

GD may investigate and take appropriate action, including termination of access, for violations.

6. Third-Party Links and Services

The Site may contain links to third-party websites or services. GD is not responsible for the content, accuracy, or practices of such third parties. You access them at your own risk, and these Terms do not apply to them.

GD is not liable for any issues arising from third-party services, including payment processors if applicable.

7. User Submissions

Any feedback, suggestions, ideas, or other submissions you provide to GD become its sole property. GD may use them without restriction, compensation, or acknowledgment.

8. Electronic Communications

By using the Site, you consent to receive electronic communications from GD, including emails regarding updates, notices, or announcements.

9. Privacy

10. Important Disclaimers – No Professional Advice; Assumption of Risk

The Site and Content provide general informational purposes only regarding self-defense, firearms training, personal protection, and related topics. The Content is not intended as, and does not constitute, professional legal, medical, safety, or firearms instruction advice.

GD strongly recommends consulting qualified professionals (e.g., attorneys, physicians, certified instructors) for any decisions involving self-defense, firearm use, training, or safety. Reliance on any Content is at your sole risk.

Firearms and self-defense activities involve inherent and serious risks, including property damage, serious injury, or death. You expressly assume all such risks and agree that GD shall not be liable for any loss, injury, damage, or consequences arising from your use of the Site, Content, or application of any information provided.

11. No Warranties; Limitation of Liability

THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

IN NO EVENT SHALL GD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR INJURY) ARISING FROM YOUR USE OF THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

GD'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $100 OR ANY AMOUNTS PAID BY YOU TO GD IN THE PRECEDING 12 MONTHS (IF ANY).

Some jurisdictions do not allow certain limitations, so the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless GD, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of this Agreement, or infringement of any rights.

13. Termination

GD may suspend or terminate your access to the Site at any time, for any reason, without notice or liability.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Washington, without regard to conflict of laws principles. You irrevocably submit to the exclusive jurisdiction and venue of the courts in Snohomish County, Washington for any disputes arising hereunder.

15. Miscellaneous

If any provision of this Agreement is held invalid or unenforceable, it shall be severed, and the remainder shall remain in effect. This Agreement, together with the Privacy Policy, constitutes the entire understanding between you and GD regarding the Site.
